§ 14-54. Existing disturbed areas.

  • (a)

    All disturbed areas which existed on May 27, 1992, as a result of a land disturbing activity and which are resulting in off-site damage from sediment and stormwater runoff, must be provided with ground cover or other protective measures, structures, or devices sufficient to control off-site sediment and nonpoint source pollution.

    (b)

    The county, acting by and through the Sumter County Soil and Water Conservation District, shall serve a notice to comply upon the landowner or other person in possession or control of the land by depositing in the mail a certified letter. The notice must state the measures needed and the time allowed for compliance. The Sumter County Soil and Water Conservation District shall consider the economic feasibility, technological expertise, and quality of work required, and shall establish reasonable time limits.
